Intensive professional testing of children with disabilities is becoming increasingly prominent within the field of children’s rehabilitation. In this paper we question the high quality ascribed to standardized assessment procedures. We explore testing practices using a hermeneutic-phenomenological approach analyzing data from interviews and participant observations among 20 children with disabilities and their parents. All the participating children have extensive experience from being tested. This study reveals that the practices of testing have certain limitations when confronted with the lived experience of (...) those who are being tested. Testing seems to transmit the experts’ view of what is important, correct and admirable, and the way in which an individual child fulfills such requirements and fits in with the predetermined standard. Regular testing may result in insecurity on the part of the tested individual, and possibly to a lack of confidence in their body and the way it functions. For the individual being tested the meaning of testing is primarily related to passing or not passing the test requirements. Given the meaning of testing, children with disabilities may experience repeated testing as an ordeal that they are expected to put up with. By illuminating the experiences of the ones exposed to testing, this paper offers new insight for professionals to gauge more accurately the quality of contemporary testing practice. (shrink)

It has been quite a year so far(!) and as the wenches we are, we have been taking our time to collect our thoughts and reflections before sharing them at the start of this issue of the journal. In this editorial we think through the COVID-19 pandemic and its devastating effects on the world, on our lives and on our editorial processes. We renew our commitment to improving our operations as a journal and its health along with our own as (...) we deploy wench tactics to restore, sustain and slow down to negotiate this new reality, this new world. We conclude with an introduction to the fascinating contents of this issue along with a collaborative statement of values on open access as part of a collective of intersectional feminist and social justice editors. Through all of the pain and suffering we focus our gaze on hope: hope that we can come through this global crisis together engaging in critical conversations about how we can be better and do better as editors, academics and individuals for ourselves, our colleagues and our journal. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

Catherine Hoffmann's Free Lunch with the Stench Wench is a performance of abjection and self-abjection through poverty with an apotropaic aspiration: to shed the shame through sharing, and to create opportunities for a common social subjectivity that refuses to be silent about the struggle of its own creation and maintenance. Despite its title, Free Lunch does not come with a free lunch for the audience but creates an olfactory situation, through the onstage cooking of hot chocolate and the presence of (...) a dead rat, which complements Hoffmann's narration and stage presence into a synaesthetic portrait of poverty and its psychosocial fallout. Drawing on the psychological foundations of shame studies, sociological approaches and social-theoretical responses to austerity and social division, I propose to examine the gendered embodiment of shame and its exorcism in Hoffmann's performance, focusing on its physical codification in and beyond the visual. I explore the potential of shame to be re-weaponized against those who originally inflict it, and consider the shame that haunts every creative act, especially those with high political stakes: the failure to make a connection, the fear of being misunderstood. As a spiritual autobiography, Kierkegaard's The Point of View for My Work as an Author stands among such great works as Augustine's Confessions and Newman's Apologia pro Vita Sua. Yet Point of View is neither a confession nor a defense; it is an author's story of a lifetime of writing, his understanding of the maze of greatly varied works that make up his oeuvre. Upon the imminent publication of the second edition of Either/Or, Kierkegaard again intended to cease writing. Now (...) was the time for a direct "report to history" on the authorship as a whole. In addition to Point of View, which was published posthumously, the present volume also contains On My Work as an Author, a contemporary substitute, and the companion piece Armed Neutrality. Gottfried Martin has recently reminded us of a useful distinction between two possible ways of doing metaphysics. We may proceed by framing a “theory of principles” or by proposing a “theory of being”. Aristotle explicitly formulates both possibilities as the task of metaphysics, formulating a theory of principles in his doctrine of the four types of causal explanation in the first book of the Metaphysics, while exploring the theory of being in a number of other passages, such as Book I, (...) chapters 6 and 9; Book X, chapter 2; and Book XIII. These passages do not elaborate principles whereby we can analyze the structure of certain entities, be they causes, substances or forms, but rather concern themselves with the ontological status of these entities—in what sense can they be said to be? In Plato this distinction is more implicit, but we may contrast the theory of forms developed in the Phaedo and the Republic with the subsequent probing investigation of the being of these forms in the Parmenides and the Sophist. Kant “explicitly claims to have discovered and presented a complete and necessary system of the basic concepts and principles. The proof of the completeness and necessity of this system is the aim of the middle part of the Critique of Pure Reason, the Transcendental Analytic.” Yet. (shrink)

The purpose of the present study was to address the shortcomings of Cronbach’s alpha concerning the semantic overlap between items. Using an example from a motivational measure, the correction of Cronbach’s alpha was applied by partialing out the effects due to conceptual overlap. The significance of Cronbach’s alpha was tested using simulated random data derived from the measure and by estimating the confidence intervals with known and unknown distributions. The results indicated that the uncorrected conceptual overlap coefficient alpha was equal (...) to 0.89 and 0.66 following the correction. After simulating the corrected statistical results, the distribution of alpha with random numbers had an estimate of 95%, equal to 0.41. The lower bound of the corrected alpha distribution was equal to 0.41, suggesting that the corrected alpha could easily belong to the distribution of alpha developed from simulated random numbers. Thus, the semantic overlap between items on a measure represents a significant threat to the validity of the alpha coefficient. (shrink)

Part of the accepted scholarly lore about Kierkegaard is that he holds that “existence”—human existence—and “the System” are mutually incompatible. For Kierkegaard, human being cannot be understood in terms of a nice, neat, complete systematic package; he shows, on this view, that the Hegelian attempt to grasp all of reality in terms of a philosophical system will always fail to grasp the reality of at least one thing: the concrete, living, existing individual human being.

William James is famous for his investigations of the “Varieties of Religious Experience” in which people encounter (what they take to be) the divine. But in his essay, “On a Certain Blindness in Human Beings,” his interest is in our experiences, not of anything purportedly supernatural, but of one another. He thinks we need to cultivate the capacity to apprehend the intrinsic value of others, even and especially of strangers. We do so in experiences of the wonder and beauty of (...) our fellow citizens, and of our harmony with them. Democratic societies require a sense of attraction to one another’s form of life if they are to inspire shared commitments to public goods. Whereas we shouldn’t reject the political significance of aversion, contestation, and dissonance, these negative attitudes do not suffice. Sustaining democratic engagement requires attractive attitudes, and among these are the wonder, beauty, and harmony that James promotes. (shrink)

The biblical image of Wisdom as the power who “orders all things well” in nature and in human life can be read in the light of contemporary information theory. Some current scientific speculation offers an interpretation of reality as a vast information‐processing system, in which informational situations are continuously transformed through algorithmic operations. This interpretation finds a metaphysical counterpart in the distinction between “nature natured” and “nature naturing” in the philosophical theology of Samuel Taylor Coleridge. This confluence of religious, metaphysical, (...) and scientific imagery suggests a picture of the world in which the processes of “nature naturing,”“human humaning,” and “God Godding” inform and recur in each other. Consideration of the work of Sade in relation to Adorno usually refers to the much-discussed chapter from Dialektik der Aufklärung. But Adorno made a number of other remarks across his career that suggest a very different reading. I will discuss the three most significant of these remarks and show how they develop an approach to the libidinal aspect of aesthetic experience that challenges our understanding of the relation of thought and language. In doing so, Sade’s works indicate an extraordinary liberation (...) of the dialectic of natural-history through a mimesis of desire, which is made apparent in what Sade’s texts literally present; in their contingency and also their facticity. There is a traditional view concerning the relation between mind and matter, knower and known. It posits a bifurcation between the two, maintaining, as Ryle puts it, that mind and matter are two distinct orders of existence. This traditional view comes, in large part, from Descartes. James rejects the traditional view, arguing instead for a close relationship between thought and object. His argument contains two components. The first stresses the close functional relationship between thought and object in our everyday experience. (...) James argues here that true thoughts do or can lead us to their objects, culminating in prosperous interaction with them. The second part of James's argument holds that in pure experience--the original flow of data within which all distinctions are to be made--there is no distinction yet made between mind and matter, knower and known. These distinctions arise only later as conceptual tools for bringing organization to the original presentations. Any given element of pure experience is categorized twice, once as an element of the physical world, and a second time as an element of the perceiver's own mental history. The conclusion, then, is that James: shows that thought and object work together in a close functional relationship in ordinary experience; and argues that they arise from one homogeneous pure experience. ;A number of criticisms were directed against James's view, including: Lovejoy's, arguing that the incompatibilities of thought and object preclude the possibility of their arising from one homogeneous source; Russell's and Perry's, arguing that James's theory is unable to extricate itself from idealism; Miller's and Bode's, arguing that James's view contradicts one of his own important tenets in The Principles of Psychology; and an argument that James is unable to account for the agency by means of which pure experience gets organized. ;James can reply plausibly to all of these criticisms including the difficult issue of the self. On this question a consistent understanding of James's basic assumptions is required. ;Finally, James's viewpoint offers an interesting critical perspective on certain contemporary theories of mind-brain identity. Patriarchal institutions govern all aspects of women's lives: their minds, their bodies, and their souls. Additionally, they govern the ways in which women are perceived by others and the ways in which women perceive themselves. (Re) Interpretations: The Shapes of Justice in Women's Experience, is a collection of essays on language, religion, war, sex trafficking, and medicine-the patriarchal structures that form the basis of western society and, thus, are in many ways inherently unjust. The essays illustrate the multitude of ways (...) that women have found to work within and without these structures to create justice. Traditional theories of justice cast it as a cardinal virtue, unbiased and impartial. The essays in this book, however, remove justice from the abstract and return it to the specific: most of the essays use personal narratives to highlight the connections all people share. The women discussed here are challenging the authority of existing patriarchal narratives by telling their versions, and, thus, calling attention to and challenging their own political and social realities. Reflecting a focus on global connectedness and interdisciplinarity, the writers of these essays aim not only to raise questions, but also to show ways in which women are creating new pathways for themselves. Only by exploring solutions will women reclaim justice. With reference to imagery from Matthias Grünewald’s masterpiece, the _Isenheim Altarpiece_, this essay considers how health-care practitioners especially— but all of us in practice—can learn to wonder in a way that does not objectify the differently abled but instead honors them. Wondering at the images in Grünewald’s work requires humility, curiosity, patience, compassion, and grit—virtues that all health-care professionals would do well to cultivate.
